USER AGREEMENT

PART III. PRIVACY POLICY

The present Privacy Policy is for your information to be fully aware of the governing regulations regarding the information Trulytaly becomes aware related to your person when you enter and/or register to the website www.trulytaly.com (hereinafter referred to as: the “Website”). The aim of the Privacy Policy hereto is to introduce what kind of information are being collected and for what purpose, how they are handled and what are the frames of their usage.



I. WHO DOES THE PRESENT PRIVACY POLICY APPLY FOR?

The Present Policy is applied for any persons accessing the Website as:

1. Seller User,
2. Buyer User,
3. Advertiser User,
4. Or Visitor.

In order to become Seller User, Buyer User or Advertiser User (hereinafter jointly referred to as: Users), the registration information described in point II/1.) is compulsory to be provided, information from Visitors described in point II/2.) are being collected automatically.



II. WHAT KIND OF PERSONAL DATA ARE HANDLED?

Personal Data shall mean any information that can be related to any exact natural person or legal entity.

During the use of the Website, the following information is being or may be collected from you.

1. Information provided voluntary

The following information related to your person are required and collected only by your own intention, when you decide to register to the Website as User. Providing of the information below is compulsory, it is a condition of registration. The data must be provided on the forms of registration.

For private persons:

- First and last name
- E-mail address
- Password

For companies:

- Corporate name
- Address of registered seat
- Phone availability
- VAT number
- CCIAA information

Furthermore, any additional information may be provided, if you think it is necessary for the fulfilment of contractual obligations.



2. Information collected automatically

The Website automatically collects the following information:

- Your IP address,
- Referring website addresses,
- Browser type and domain
- The frequency you access the Website.

The collecting of such information is independent from registration to the Website, by visiting they are automatically being provided to Trulytaly.

Trulytaly shall never request sensitive personal information such as race, religion, political views, health information, etc.



3. Payment data

Trulytaly does not require or store any data related to payment information. No payments are being performed on the Website. Payments for products or registration fees are performed on platforms, with which Trulytaly has no direct or indirect relation, therefore on their activity and operation Trulytaly has no influence. For this reason, Trulytaly shall never become reliable for any losses or damages related to the use of such platforms.



III. INTENDED USE AND PURPOSE

Trulytaly collects personal data to identify and register its Users and Visitors, to invoice the fees of services, to provide basis for statistics on the activities of the Website, also if requested to provide newsletters and various offers.

Trulytaly does its best to use the least personal data possible. However, in order to assist the performance of the orders and shipments, the usage of the already given information may become necessary.

We kindly drive your attention, that exceeding the data described in point II.), collection of further personal information may become necessary for the purpose of fulfilment of contractual obligations, for which the same way the present Privacy Policy shall be applied accordingly.

The data collected from you provide the basis for statistics of Trulytaly.



IV. NON-DISCLOSURE

Trulytaly does its best not to sell, share, or otherwise distribute Personal Data to any third parties except as provided in this Privacy Policy. However, Trulytaly has the right regarding Personal Data to be transferred to third parties who act for n Trulytaly’s for marketing, data management or technical support.


Personal Data collected from you may also be transferred to a third party in the event that the Website or Trulytaly or a part of them and the registered data connected with them is being sold, assigned or transferred, in which case Trulytaly requires the buyer, assignee or transferee to treat all Personal Data in accordance with the Privacy Policy hereto. Also, Personal Data may be disclosed to a third party if we are required to do so because of an applicable law, court order or governmental regulation, or if such disclosure is otherwise necessary in support of any criminal or other legal investigation or proceeding here or abroad.

This also applies when we have reason to believe that disclosing the Personal Data is necessary to identify, contact or bring legal action against someone who may be causing interference with our rights or properties, whether intentionally or otherwise, or when anyone else could be harmed by such activities.



V. CONSENT

By visiting or registering to the Website, you give your expressive and irrevocable consent for Trulytaly to use your personal data for the purposes of the Website in accordance with the regulations of the Privacy Policy hereto.



VI. RESPONSIBILITY FOR THE PROVIDED DATA

All Users of the Website are obliged to provide true, valid and up to date information. All Users must register any changes in the information provided for their account without any delay.

Providing false personal data or abuse of personal data leads to the suspension of the account and Trulytaly has the right to report such manner for the competent authorities if it is considered as necessary.



VII. COOKIES

The Website uses cookies which amongst others, helps Trulytaly to improve your experience of the
Website in order to reach the best performance meeting your expectations.

Cookies are text files containing small amounts of information, which are downloaded to your computer or mobile device by the websites that you visit. They can improve your experience of using a website, for example, by remembering your preference settings and tracking your use of a website so that it can be improved to meet your needs. You have the ability to accept or decline cookies by modifying your browser settings. The Website will be viewable to you even if you disable the cookies, however, in this case some advanced and customized features will not be available to you.



VIII. LINKS TO OTHER SITES

The Website contains links to other sites that are operated by third party companies, which are independent from Trulytaly with different privacy practices and policy. Trulytaly warns its Users and visitors to remain alert when leaving the Website and to read the privacy statements of the other websites. Trulytaly has no control over the Personal Data that are being collected or received from these third parties.

IX. CHANGES OF THE PRIVACY POLICY

We will post on our Website any changes to this policy with the effective data of the changed policy, so that you can be informed of the way we collect and use your Personal Data at all times. If at any point we decide to use the Personal Data you submitted under this current policy in a way that differs materially from the Privacy Policy that applied at the time of your registration, you will be notified and given the opportunity on the Website, email or in writing to prohibit or otherwise prevent such usage.



X. SOCIAL MEDIA

Trulytaly and the Website are being represented on different forms of social media (e.g. Facebook, Twitter, Instagram, etc.). Therefore all Users give their unconditional and irrevocable consent that their information related to their person may appear and may be visible to the public visiting such platforms (e.g. the profile becomes linked to the Website or Trulytaly). For such appearance no compensation or claims can be settled towards Trulytaly.



XI. STORING OF DATA

All Personal Data that has been collected from you will only be stored for a limited duration that is relevant to the purpose for which it was collected and processed as long as it is necessary within the limits of the applicable law.



The Privacy Policy (Part III.) hereto shall be interpreted and applied in accordance with the other parts of User Agreement.
